Time Warner, Viacom Take iPad App Feud To Court

Time Warner Cable Inc. and Viacom Inc. took their dispute over what content can be put on the cable company's iPad app to federal court on Thursday, asking a judge to decide the issue. The companies filed lawsuits against each other after Time Warner agreed to drop a dozen cable channels from the popular tablet computer sold by Cupertino, Calif.-based Apple Inc. News Corp.'s Fox Cable Networks, Viacom and Discovery Communications Inc. had asked Time Warner to pull their programming from its iPad app, which was launched last month. They said putting the programs on it was violating their programming contracts. The media companies say Time Warner should pay more money to distribute on devices other than television sets. Time Warner says existing contracts already provide it with the rights. Viacom said in its lawsuit that it cannot let Time Warner "unilaterally change the terms of its contractual relationship." It acknowledged that the cable company had taken the cable channels off the tablet computer by April, but it said a court order would be necessary to keep the company from putting the channels back on. It also asked for $2 million for each violation of the contract between the companies, along with unspecified additional damages. Viacom Sues Cablevision over iPad Video App

Viacom Inc., the owner of MTV, Comedy Central and other television channels, accused cable TV distributor Cablevision Systems Corp. on Thursday of making its shows available on the iPad without permission. Viacom is seeking millions of dollars in damages and an injunction to stop Cablevision from distributing an iPad app that lets subscribers watch live channels and get shows on demand. Viacom says the app infringes on its copyrights. The app, called Optimum, is part of a move by cable, satellite and other TV providers to give paying subscribers the ability to watch programs on a variety of devices. There's no extra charge beyond what subscribers already pay monthly for television service. Some call the concept "TV Everywhere," although the Optimum app doesn't allow subscribers to view shows over cellphone networks or Wi-Fi hotspots outside their home. Viacom Wants YouTube Copyright Ruling Scrapped

A lawyer for Viacom Inc. warned an appeals court panel Tuesday that there will be greater exploitation of copyright material on the Internet if the court lets YouTube get away with a business built on "rampant copyright infringement." The lawyer, Paul Smith, told a three-judge panel of the 2nd U.S. Circuit Court of Appeals in Manhattan that a lower court judge was wrong to rule that Google Inc.'s popular video service was protected from copyright infringement claims. "YouTube not only knew there was rampant copyright infringement on the site but welcomed it," Smith said. "These people made this kind of money on somebody else's property." Google purchased YouTube for $1.76 billion in 2006, comfortable that it was protected by the safe harbor provision of the 1998 Digital Millennium Copyright Act. That provision shields a company from liability if they don't have actual knowledge of copyright infringement. Once notified, the company must eliminate the infringement quickly. Google attorney Andrew Schapiro countered that YouTube follows the law and always has by taking down video when a copyright owner claims the video infringes its rights. "There is no evidence, zero, of a single clip in this case that YouTube knew was infringing and failed to take down," he said. Schapiro said Viacom's chief complaint seemed to be that Google was not screening for copyright violations in the manner Viacom preferred. "We've done A, B, C and D and plaintiffs are saying, `You should have done E and F,'" he said. "IF we did E and F, they would say, `You should have done G and H.'"
