Apple Gets Restraining Order in Europe Against Samsung

Apple has won a court ruling in Germany for a retaining order to stop South Korea's Samsung from marketing its Galaxy Tab 10.1 tablet computer in most of Europe, the German Press Agency dpa learned Tuesday. In the latest legal skirmish in a patent and copyright battle between the two companies, the restraining order applies everywhere in the European Union except for the Netherlands, sources close to the negotiations told dpa. The restraining order by a state court in Dusseldorf applies both to the German unit Samsung Electronics GmbH in Schwalbach, Germany as well as to the parent company in South Korea, the sources said. The order comes just as Samsung was getting ready to launch the Galaxy Tab 10.1 in Germany this month. Apple has filed to have Samsung fined 250,000 euros (360,000 dollars) or punished for contempt of court if the South Korean company die not comply. The dispute came to a head in April, when Apple sued Samsung in the United States alleging that the Galaxy phone and tablet copied features from the iPhone and iPad. Samsung countersued. Since then the legal wrangle has spread to several countries. In early August, Samsung postponed the launch of the Galaxy Tab 10.1 in Australia, where Apple had filed suit seeking an order to prohibit sales of the Galaxy elsewhere in the world. Court Rules Samsung Can't Sell Tablet in Germany

Samsung Electronics cannot sell its new Galaxy Tab 10.1 tablet computer in Germany after a court ruled Friday that its design "too closely" resembles Apple's iPad2. The ruling by a Duesseldorf state court, however, only applies to direct sales from the Seoul, South Korea-based company, meaning distributors who acquire the Galaxy Tab 10.1 from abroad could resell them in Germany. Apple had taken Samsung to court over its Galaxy line, arguing their design is too close a copy of their own products. Samsung said in a statement it will appeal the ruling, which it said "severely limits consumer choice in Germany." Already in August, the court ruled in favor of Apple, based in Cupertino, California, forcing Samsung to withdraw its tablet from the European market. It later determined the injunction only applied to sales in Germany, where it had not yet been launched. "We also believe that by imposing an injunction based on this very generic design right, this ruling restricts design innovation and progress in the industry," Samsung said. Judge Johanna Brueckner-Hofmann said in her ruling that Samsung, "did not keep the necessary distance" in its design, the news agency dapd reported. Apple patented its design in 2004, and Brueckner-Hofmann cited products from Asus, Acer and Toshiba as examples of tablet computers that nonetheless have a clearly different design. Samsung Releases Tweaked Tablet To Avoid German Injunction

The worldwide war between Samsung and Apple has taken a new turn. Samsung has released a slightly tweaked version of its Galaxy Tab tablet in Germany, in order to get around a legal injunction obtained by Apple. The new model is called the 10.1N. In August, Apple won a preliminary injunction that blocked the Android-based Galaxy Tab 10.1, because of an alleged design infringement. The injunction, which currently applies only to Germany, also claimed the Tab was an iPad imitation. 'N' and a Bezel The only discernible difference in the new model, aside from the addition of the letter "N," is that a metal frame, or bezel, now wraps around the edge of the device. Florian Mueller, whose Foss Patents site follows technology-related patents, wrote Wednesday that, in Germany, a design is infringed "only if all of its key characteristics are matched, or if that is the overall impression of an informed person." He noted that the Tab still has the same rounded corners, even with the bezel, but that what's protected for Apple under German law is "a set of characteristics and the overall impression it makes." In addition to countersuing Apple in a variety of countries, Samsung has also changed the way its software allows users to flip through a photo gallery on its Galaxy smartphones, in order to get around a Dutch injunction sought by Apple for a software infringement. Mueller speculates that, if the 10.1N passes legal muster in Germany, Samsung may be able to avoid a similar, pending injunction sought by Apple in the U.S. It is expected that if this design modification doesn't satisfy the German court, Samsung will tweak the tablet's physical design again and again, and keep resubmitting it to the court, until it does. Apple, Motorola in Patent Struggle in Germany

Apple Inc. has temporarily blocked Motorola Mobility's attempt to have it withdraw several iPhone and iPad models from its Internet store in Germany, the latest twist in an extended legal duel over patents between the companies. The sale of the devices was briefly halted after Libertyville, Illinois-based Motorola Mobility Holdings Inc. enforced a ruling it won against Ireland-based Apple Sales International Inc., from a court in Mannheim, Germany. The court had earlier ruled that Apple should not be using Motorola's mobile technology in the devices without a license. Motorola Mobility moved to enforce the decision and Apple announced Thursday it was halting online sales. A few hours later, Apple said it had won a suspension from an appeals court in Karlsruhe. "All iPad and iPhone models will be back on sale through Apple's online store in Germany shortly," Apple said in a statement. "Apple appealed this ruling because Motorola repeatedly refuses to license this patent to Apple on reasonable terms, despite having declared it an industry standard patent seven years ago." Apple says Motorola Mobility has refused to license the technology even though Motorola agreed it should be an industry standard. In a statement Friday, Motorola Mobility said it will continue to pursue claims against Apple. It said Apple had refused to negotiate in good faith. The devices in question were the iPhone 3G, the iPhone 3Gs and the iPhone4 and UMTS-capable iPads -- but not the iPhone 4S. Florian Mueller, an intellectual property consultant who has been reporting on the cases on his blog FOSS Patents, said that the wording of the Karlsruhe decision only suspends enforcement of the decision until the court can hear a response from Motorola.
