Google did not infringe on the patent rights of database giant Oracle in its creation of the Android operating system, a San Francisco jury decided Wednesday, ending the long and bitter litigation between the two tech giants that began in 2010. The jury foreman checked off "no (not proven)" eight times in answer to claims by Redwood Shores, Calif.,-based Oracle that Google infringes on two of its patents. Earlier Verdict On Copyrights Oracle, however, did win in an earlier phase of the trial, decided on May 7, when the jury sided with Oracle's separate claim that Google infringed on some copyrights, to a small degree. Judge William Alsup of U.S. District Court in Northern California will decide after a break for Memorial Day weekend whether any damages will be awarded in that claim. Oracle's original claim was for $6.1 billion in damages, but Alsup ordered that the estimate be revised, and in February Oracle revised the figure to $230 million. The original claim involved six patents. The judge must also make a determination on whether copyright law applies to application program interfaces, which will affect whether damages can be awarded. The case centered on the Java programming language that became Oracle's property when it purchased Sun Microsystems. Oracle insisted that the open-source Android, now the most popular operating system in both the domestic and global markets, could not have been created without Java, with Google even hiring engineers who worked on Java, while Google insisted it instead used a language called Apache Harmony. Google Wallet hopes to make a comeback -- or at least turn some heads -- when it debuts on its second device. After a poor reception on Sprint in September, Google Wallet is about to show up on the LG Optimus Elite through Virgin Mobile. Google Wallet is a free Android app that lets customers turn their smartphones into wallets and make purchases with the tap of the phone. The app stores virtual versions of your credit cards, offers and loyalty cards on the smartphone. Google Wallet currently supports Citi MasterCard credit cards and the Google Prepaid MasterCard, powered by First Data. Google plans to support additional cards. Some of the hundreds of thousands of participating retailers include American Eagle Outfitters, The Container Store, Macy's, Foot Locker and Subway. Google Wallet's Slow Take-Off The Optimus Elite debuted on Sprint's network on Sept. 20. Now, Virgin Mobile is getting into the Google Wallet game by offering the device, which features Android 2.3 Gingerbread. In order to run Google Wallet, smartphones need NFC, or near-field communication, capability. NFC is a short-range communication protocol that's similar to Bluetooth. What does the Android operating system and a can of half-price tuna at the supermarket have in common? Both, it seems, are loss-leaders, examples of big-picture thinking to gain a long-term profit from a short term loss. Just as the cheap tuna brings customers into a store to buy the overpriced items, Android seems to represent resources devoted by search giant Google without immediate profit in order to keep people using their site as a tour guide of the Internet and downloading apps and other digital multimedia content from Google Play. 'Big Loss for the Whole Year' In papers related to the lawsuit alleging that Android infringes Oracle's copyrights, the company provided figures that were read in court by U.S. District Judge William Alsup. According to Reuters, there was no net gain from Android in all four quarters of 2010, quoting Alsup as saying, "That adds up to a big loss for the whole year." The jury was not present at the time. Reuters said Android revenues for 2010 were about $97.7 million. Showing a loss would make it more difficult for Oracle to say that Google stole Java copyrights for Android to profit from it. There is plenty at stake for Google if it loses, namely $1 billion and an ongoing royalty to Oracle to use the Android operating system. Android powers more than 300 million tablets and smartphones and Google has banked on the technology to help drive its mobile strategy forward. Google offered up its defense in a San Francisco federal court on Tuesday during a trial with potentially dramatic implications for the mobile operating system maker. Oracle is charging both copyright and patent infringement and wants Google to shell out $1 billion in damages. Oracle also wants the court to block Google from distributing the open-source Android operating system without paying Oracle licensing fees. Oracle argued on Monday that Google recognized the need to license Java, which Oracle acquired when it bought Sun in 2010, in order to make Android work. Google vehemently disagrees. Incriminating E-Mails? "Google didn't need a license to use the Java language in Android," Bloomberg quoted Robert Van Nest, an attorney for Google, as telling the jury on Tuesday. It's been a bitter out-of-court battle, and now it has landed in the courtroom. Oracle is suing Google for patent and copyright infringement surrounding the Android operating system. Oracle argued that Android uses Java technologies to compete with Java, which is itself a competitive mobile operating system. Google did not immediately respond to Oracle's allegations. But in October, Google emerged with a response that Google's platform, including its Dalvik virtual machine, does not violate Oracle's intellectual property. Google has called the suit an "attack on both Google and the open-source Java community," and has argued that Oracle's claims are "baseless." Google said although software applications for the Android platform may be written in the Java programming language, the Dalvik byte code is distinct and different from Java byte code. The Dalvik VM is not a Java VM. But Oracle maintains that "in developing Android, Google knowingly, directly and repeatedly infringed on Oracle's Java-related intellectual property."
